1. OVERVIEW
At Jhonny Foursclose, we are committed to providing a reliable and transparent shopping experience.
We want every customer to feel confident when purchasing from our collection of men's clothing and accessories.
This Return & Refund Policy explains how returns, exchanges and refunds are handled, including your rights under the Australian Consumer Law (ACL).
Our voluntary return arrangements operate in addition to, and do not replace or limit, your statutory consumer rights.
Nothing in this policy is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded under Australian law.
2. AUSTRALIAN CONSUMER LAW
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
Under the ACL, consumers are entitled to expect that products:
-
Are of acceptable quality.
-
Are safe, durable and free from defects.
-
Match their advertised description.
-
Match any applicable sample or demonstration model.
-
Are fit for their normal purpose and any particular purpose made known to us where the relevant legal requirements are met.
-
Meet any express warranties or promises made about them.
If a product fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund or compensation, depending on the circumstances.
For a major failure, you are entitled to choose between a refund and a replacement, subject to the applicable provisions of the ACL.
You may also be entitled to compensation for reasonably foreseeable loss or damage.
These rights apply independently of our voluntary change-of-mind policy and may continue beyond its stated return period.
3. CHANGE-OF-MIND RETURNS
We offer a voluntary 30-day return period for eligible change-of-mind purchases.
If you are not completely satisfied with your purchase, you may request a return within 30 calendar days of receiving your order.
This includes circumstances where:
-
You have changed your mind.
-
You have selected an unsuitable size or colour.
-
The item does not suit your personal preferences.
-
You no longer wish to keep the product.
To qualify for a voluntary change-of-mind return, the product must:
-
Be unused, unworn and unwashed, except for reasonable handling necessary to assess its fit and appearance.
-
Be in its original, resaleable condition.
-
Have its original tags attached.
-
Include its original packaging and accessories, where applicable.
-
Be accompanied by proof of purchase.
Customers are responsible for return postage costs for voluntary change-of-mind returns.
Original delivery charges are not refunded for change-of-mind returns.
These conditions apply only to voluntary returns and do not restrict your rights under the Australian Consumer Law.
4. HOW TO REQUEST A RETURN
To request a return, please contact our customer support team.
Email: support@jhonnyfoursclose.store
Please include the following information:
-
Your full name.
-
Your order number.
-
The email address associated with your purchase.
-
The product you wish to return.
-
The reason for your return.
If your item is damaged, defective or incorrect, photographs may help us assess and resolve the issue more efficiently.
Photographs are helpful but are not an absolute requirement for exercising your statutory consumer rights.
Our customer support team will review your request and provide the appropriate return instructions.
For voluntary change-of-mind returns, please contact us before posting your item so we can provide the correct return destination.
Do not return a parcel to the address printed on its original shipping label unless our team confirms that it is the correct return address.
Requests involving statutory consumer rights will be assessed independently of our voluntary return approval process.
5. DAMAGED, DEFECTIVE OR INCORRECT ITEMS
If you receive a damaged, defective, unsafe or incorrect product, please contact us as soon as reasonably possible.
We will review the issue and provide an appropriate remedy in accordance with the Australian Consumer Law.
A major problem may include a product that:
-
Is unsafe.
-
Is significantly different from its description or sample.
-
Has a problem that would have prevented a reasonable consumer from purchasing it had they known about the issue.
-
Cannot perform its normal or disclosed purpose and cannot easily be fixed within a reasonable time.
Where a product has a major failure, you may choose a refund or replacement in accordance with the ACL.
Where a product has a minor failure, we are entitled to provide a free repair or otherwise remedy the problem within a reasonable time.
If we cannot or do not remedy a minor failure within a reasonable time, you may become entitled to further remedies, including a refund or replacement.
If we have supplied the wrong item, we will arrange an appropriate correction at no additional cost to you.
We will not require customers to accept store credit in place of a refund to which they are legally entitled.
Your statutory rights are not conditional upon retaining original packaging, leaving the product unused or reporting the problem within our voluntary 30-day return period.
6. RETURN SHIPPING COSTS
Return postage arrangements depend on the reason for the return.
Change-of-Mind Returns
Customers are responsible for the cost of returning products under our voluntary change-of-mind policy.
We recommend using a tracked postal service and retaining proof of postage.
Faulty or Non-Compliant Products
Where a product is confirmed to have a problem covered by the Australian Consumer Law, we will reimburse reasonable return costs incurred by the customer.
Please retain your postage receipts so that reasonable return expenses can be reimbursed.
Where the ACL requires us to collect an item at our expense, we will arrange collection within a reasonable time.
Customers will not be charged restocking, repair or processing fees for exercising their statutory rights in relation to faulty products.
Any entitlement to a refund of original delivery charges or additional compensation will be assessed in accordance with applicable law.
7. REFUND PROCESS
Once your return has been received, or your entitlement to a refund has otherwise been established, we will process the refund in accordance with this policy and applicable law.
For eligible voluntary change-of-mind returns, we will inspect the returned product to confirm that it meets the conditions set out in Section 3.
Approved refunds will be issued without unreasonable delay.
Refunds will ordinarily be made using the original payment method unless you agree to another method.
The time required for funds to appear in your account may vary depending on your bank or payment provider.
For a refund required under the Australian Consumer Law, we will refund the amount to which you are legally entitled.
We will not substitute store credit for a legally required monetary refund without your agreement.
We will not deduct restocking fees or amounts for ordinary prior use where such deductions would be inconsistent with your statutory rights.
8. EXCHANGES
If you wish to exchange an item for a different size or colour, please contact us at:
support@jhonnyfoursclose.store
Voluntary exchanges are subject to the availability of the requested replacement item and the change-of-mind conditions outlined in Section 3.
If the requested replacement is unavailable, we will discuss the available alternatives with you, including an eligible return and refund.
Customers are responsible for return postage costs for voluntary change-of-mind exchanges.
If an exchange or replacement is required as a remedy under the Australian Consumer Law, the relevant statutory rights and obligations will apply instead.
9. SALE AND PROMOTIONAL ITEMS
Products purchased during sales, promotional campaigns or special offers remain protected by the Australian Consumer Law.
A discounted product is not excluded from statutory consumer guarantees simply because it was purchased on sale.
Where a promotional product has a major failure, consumers retain their statutory right to choose a refund or replacement, as applicable.
For voluntary change-of-mind returns, sale and promotional items are eligible under the same 30-day return conditions unless a specific exclusion was clearly disclosed before purchase.
No promotional term will override your statutory consumer rights.
10. PRODUCTS THAT CANNOT BE RETURNED UNDER OUR VOLUNTARY POLICY
We may decline a voluntary change-of-mind return where:
-
The request is made outside the 30-day voluntary return period.
-
The product has been worn beyond reasonable fitting, washed, damaged or altered after delivery.
-
The original tags have been removed.
-
The product is no longer in a resaleable condition due to handling beyond what is reasonably necessary to inspect it.
Any product-specific exclusions from voluntary returns will be clearly disclosed before purchase.
These exclusions do not apply where a customer is entitled to a remedy under the Australian Consumer Law.
Products that are faulty, unsafe, incorrectly described or otherwise fail to meet applicable consumer guarantees will be assessed in accordance with the ACL, regardless of their voluntary return eligibility.
11. LOST, MISSING OR UNDELIVERED ORDERS
If your order has not arrived, please contact our customer support team.
We will investigate the delivery status and work with the relevant delivery provider to determine what has happened.
If we cannot supply your order, or if it is not delivered within the agreed or otherwise legally required timeframe, we will provide an appropriate remedy in accordance with Australian law.
Depending on the circumstances, this may include replacement, cancellation or a refund.
Customers will not be automatically denied a remedy solely because a parcel has been handed to a shipping provider.
We will assess each case based on the relevant delivery circumstances and our legal obligations.
12. PROOF OF PURCHASE
We may request reasonable proof of purchase when assessing a return, exchange or refund.
Acceptable evidence may include:
-
An order confirmation email.
-
An order number.
-
A receipt or invoice.
-
A relevant payment record.
-
Another reasonable record demonstrating that the product was purchased from our store.
An original paper receipt is not the only acceptable form of proof of purchase.
13. OUR RESPONSIBILITY AS THE RETAILER
Jhonny Foursclose is responsible for addressing applicable consumer guarantee claims relating to products purchased from our store.
Where the Australian Consumer Law makes us responsible for providing a remedy, we will not require customers to deal exclusively with a manufacturer, supplier or shipping company.
Our obligations remain subject to the applicable provisions of Australian consumer protection legislation.
14. INTERNATIONAL FULFILMENT AND RETURNS
Some orders may be dispatched or fulfilled through international logistics arrangements.
Customers will be provided with the applicable return destination and instructions before sending products back.
For voluntary change-of-mind returns, the customer is responsible for the applicable return postage costs, including international postage where relevant and disclosed before purchase.
International fulfilment arrangements do not remove or restrict applicable consumer guarantees under the Australian Consumer Law.
Where a product does not meet an applicable consumer guarantee, we will meet our obligations regarding return costs, remedies and refunds.
15. CONSUMER RIGHTS AND ADDITIONAL REMEDIES
Nothing in this policy limits any right or remedy available under the Australian Consumer Law or any other applicable law.
In particular:
-
Consumer guarantees cannot be excluded by our store policies.
-
Statutory remedies cannot be denied solely because the voluntary return period has expired.
-
A manufacturer's warranty does not replace or limit statutory consumer guarantees.
-
Original packaging cannot be imposed as an absolute requirement for statutory remedies.
-
Consumers may be entitled to compensation for reasonably foreseeable loss or damage resulting from a failure to meet a consumer guarantee.
Any voluntary benefits provided by Jhonny Foursclose are additional to the rights and remedies provided by law.
